Upstate New York Trooper Avoids Criminal Charges in Fatal Pedestrian Accident

An ex-trooper from Albany, New York, who ran over a drunk man lying across a rural New York road in May will not face criminal charges in the case.

A grand jury decided not to charge the 32-year-old trooper with a pending felony charge of leaving the scene of a fatal accident, determining that the victim may have been already run over by another motorist.

The accident occurred on May 22 around 2:30 a.m. when the trooper, who was off duty at the time, hit a 29-year-old man with his pickup truck in Broadalbin, New York, which is about 35 miles northwest of Albany. The victim had reportedly been walking home from a nearby bar. His autopsy revealed a blood alcohol content of .20.

The officer’s girlfriend called 911 to report a body in the road before the couple left the scene. Investigators later traced the call back to the officer and determined that he was not intoxicated. This 911 call also gave a jury reason to question the “leaving the scene of a fatal accident” charge that the officer faced.

The man is no longer a trooper, though The Seattle Post-Intelligencer says it’s unclear whether he resigned or was fired.

The victim was father to two children, a 10-year-old boy and seven-year-old girl. According to the Times Union, the mother of his son has said that she plans on filing a wrongful death suit against the ex-trooper on behalf of her son.

“There might have been a possibility of saving his life,” the woman said. “I have a 10-year-old who wants answers.”

Upstate New York Groom Dies in Wedding Night ATV Accident

In an accident that the bride’s father calls “a living nightmare,” a 25-year-old groom died in a Dover Plains, New York, ATV accident on his wedding night this past Saturday.

The 25-year-old Wingdale resident had been a passenger on a side-by-side ATV driven by his 23-year-old brother only hours after his wedding reception at a hotel in Shermann, Connecticut.

USA Today reports that the accident occurred at 11:30 p.m. on Ore Bed Road near Dover Furnace Road when the Can-Am Commander 1000 UTV—described as a “high-end, four-wheeler with a powerful V-twin engine”—hit a tree and flipped over on the road, pinning the groom underneath.

The man was pronounced dead at New Milford Hospital in Connecticut, where he died of blunt force trauma to the head, chest, and abdomen. The brother was also treated for non-life-threatening injuries.

“It appears that alcohol was a factor in the accident,” said New York State Police Sgt. L. Daniele. “[The groom’s brother] was charged with driving while intoxicated. Further charges are pending.”

Earlier in the day the victim had married a 22-year-old nurse from Carmel, New York, at the Holy Trinity Roman Catholic Church in Shermann.

The ATV was owned by the groom’s younger brother.

Husband and Wife Dead After Van Crashes Through Amherst Restaurant

A minivan crashed through a burger joint in Amherst, New York, on the night of Saturday, September 17, killing two patrons inside and injuring two others.

The Buffalo News reports that the crash occurred around 9:30 a.m. at Cheeburger Cheeburger, located at 1593 Niagra Falls Boulevard.

A 74-year-old female driver from the Town of Tonawanda was reportedly trying to park in front of the restaurant when she suddenly accelerated, jumped a curb, and crashed through the restaurant’s glass front.

The car pinned a Danville married couple against the wall of the restaurant. The 56-year-old husband was taken to Millard Fillmore Suburban Hospital, where he was pronounced dead that night. His 52-year-old wife died at Erie County Medical Center late the following morning.

Their 13-year-old son and a 20-year-old waitress were also struck during the crash.

The son was taken to Erie County Medical Center with non-life-threatening injuries.

The waitress was taken to Millard Fillmore Suburban Hospital with minor injuries.

Neither the van’s driver nor her passenger were hurt in the accident.

“I heard the glass shatter and saw dust,” said witness Bonnie Kane to a Buffalo News reporter. “Oh, my God, this is unbelievable to see this.”

Disaster Narrowly Avoided When Semi Crashes Off Thruway in Bowmansville

A 51-year-old male from Queens, New York, recently crashed a semi-truck off the Thruway in Bowmansville. The driver plowed through a guardrail before nearly colliding with a gas line valve—an incident that authorities now say could have caused a disastrous explosion.

The crash occurred around 2:37 a.m. on Friday, September 9, when the driver lost control of his 2006 Volvo truck. The rig sideswiped another car before crossing the grass center median, traveling across both eastbound lanes, and crashing through a guardrail and down an embankment. The rig came to a rest after destroying a shed that contained a National Fuel gas line valve.

Lancaster Emergency Management Team Coordinator Robert McPeek told The Buffalo News that the crash “could have caused a big explosion” had the truck not missed hitting the major line by “about a foot.”

As a precaution, police shut down an 18-mile stretch of the Thruway between Pembroke and Youngmann Expressway and evacuated residents in about 20 nearby homes.

The Buffalo News reports that the driver, who was listed in fair condition earlier this week, may have suffered a stroke while driving.

The State Police’s commercial vehicle investigation unit is still working to determine the cause of the crash.

Off-duty NYPD Officer Killed By Drunk Driver

A car crash in Long Island, New York, claimed the life of a 25-year-old off-duty NYPD officer over the weekend. At fault? A 20-year-old man who police say was driving drunk when he rear-ended the officer on the Southern State Parkway in Massapequa at 5:30 a.m. on Sunday, September 11. The collision forced the officer’s Nissan Maxima to smash through a guardrail before flipping over and rolling into a wooded area. The drunk driver also reportedly hit another vehicle whose driver was not injured.

However, the officer was pronounced dead at Nassau University Medical Center, while his 30-year-old girlfriend was treated for non-life threatening injuries.

Shortly afterwards police arrested an East Meadow man on charges of vehicular manslaughter, driving while intoxicated, reckless driving, assault and speeding. On Monday he was arraigned in First District Court in Hempstead. He is being held on $100,000 bail.

The Wall Street Journal reports that the young officer had been a member of the NYPD since July 2008 and worked with the 106th Precinct.

“He wanted to become a cop after 9/11,” the cop’s father told the New York Daily News. “I gave him my blessing. And ironically he died on 9/11. 9/11 has a whole new meaning now … It’s the worst damned day ever.”

Chappaqua Doctor Killed in Freak Car Accident

A 49-year-old doctor from Chappaqua, New York, died when a car hit him on the Taconic State Parkway on the morning of Thursday, September 8, after he’d gotten out of his car following an accident.

The Journal News is reporting that around 8 a.m. the gastroenterologist had been headed northbound to work in Fishkill when his Toyota Highlander lost traction on the rainy highway near Peekskill Hollow Road.

The man’s SUV careened into a rock outcropping, then across the road and into a guardrail before stopping across both northbound lanes. Uninjured, the man got out of his vehicle, but was then hit by a northbound vehicle driven by a 41-year-old Yorktown woman who had just come around a slight bend in the road.

The woman reportedly tried to stop when she came upon the man’s wrecked car, but lost control of her car, spinning 180 degrees and hitting the same rocks that the man had struck only minutes earlier. Her car then plowed into the man and his car.

“There are no charges at this time and, from our initial investigation, it appears that [the woman] is not at fault,” said Senior Investigator Brian Hoff.

Witnesses to the crash are being asked to call investigators at 914-788-8044.

The deceased practiced at St. Francis Hospital and Vassar Brothers Medical Center.

Four teens killed in Buffalo auto accident

WCAZ reports that four teens were killed in a Buffalo auto accident. The New York car accident occurred when the 18-year-old driver disregarded a stop sign and collided with a mini-van.

The driver of the Nissan and his three teenage passengers were all killed in the accident. Two adults in the minivan were taken to the hospital to be treated for injuries following the Buffalo car accident.

The teenage driver was going 90 miles per hour at the time of the Buffalo auto accident. Alcohol was not believed to be a factor in the crash.

Driver rear-ended, injured in New York truck accident

The Post-Standard reported that a woman was injured in a New York truck accident Friday morning.

The auto accident happened when the woman slowed down for a school bus and was rear-ended by a tractor-trailer. The New York car accident victim was taken to a Syracuse hospital by ambulance for her injuries, while the driver of the tractor-trailer was un-injured.
